The Ministry of Antimonopoly Regulation and Trade found a violation of advertising legislation in the operations of the 21vek.by online hypermarket, which is operated by Triovist LLC.
Under the rules of the bonus programme, the store sends customers information about their bonus accounts and accumulated points by text message or email. Such information is not considered advertising.
However, one message sent to a customer contained advertising in addition to information about the bonus programme. The customer had not consented to receiving advertising materials. The customer asked Triovist LLC not to send advertising without consent but was refused.
Following an inspection, MART ordered Triovist LLC to remedy the violation. The company complied with the requirements within the prescribed period.
