Government Changes Rules for Procurement Using Own Funds

Belarus’ Council of Ministers has adopted a resolution “On the Procedure for Procurement of Goods (Works, Services) Using Own Funds”.

According to the government’s press service, the resolution will enter into force three months after publication. It has not yet been published.

The resolution provides for the digitalisation of the procurement process in line with the procedures used for public procurement. Competitive procurement procedures will now have to be conducted electronically. Previously, only the invitation to participate in a competitive procurement procedure had to be published in open access. An exception is made for procurements containing information classified as restricted official information.

The resolution establishes a single procurement procedure for organisations at both the national and local levels.

The legislation on procurement using own funds will not apply to:

  • procurements exceeding 100 base units (previously, procurements without regard to the requirements of Resolution No. 229 were allowed for amounts up to 1,000 base units an unlimited number of times),
  • participants in state-owned holding companies,
  • lease agreements, including financial lease agreements (leasing).

A ban is introduced on the participation in procurements of persons affiliated with the purchasing organisation, entities involved in terrorist and extremist activities, and legal entities that have been held administratively liable for corruption-related offences.

The grounds for procurement without compliance with legislation on procurement using own funds are being reduced, although exemptions remain for the procurement of oil, telecommunications services, real estate, goods at fixed prices, and goods or services requiring urgent decisions, among others.

Special provisions have been established for leasing equipment and for the performance of work and services using equipment, including trucks, special-purpose vehicles, trailers and semi-trailers, agricultural and forestry machinery, tracked tractors, bulldozers and excavators under specific national classification codes.
