Polish Court Overturns Decision to Transfer Kupchyna Under Dublin Regulation

The Voivodeship Administrative Court in Warsaw has overturned a decision to transfer former political prisoner Tatsiana Kupchyna under the Dublin Regulation. This was reported by the Partyzanka initiative. In accordance with the court’s ruling, Kupchyna’s application for international protection will be рассмотрed in Poland.

The appeal against the transfer decision under the Dublin Regulation was prepared by Hanna Matsiyeuskaya.

“This decision is important not only for Tatsiana. It creates a precedent for other cases where people are being transferred without proper assessment of their situation,” the initiative said.

In 2022, Tatsiana Kupchyna was sentenced to two years in prison on politically motivated charges, including insulting Lukashenka. After her release, she was forced to leave Belarus due to ongoing surveillance. Kupchyna entered the EU on a Lithuanian visa but sought international protection in Poland, where she has close contacts.
