Supreme Court Backs MART in Dispute With A1

Belarus’ Supreme Court has sided with the Ministry of Antimonopoly Regulation and Trade (MART) in its dispute with mobile operator A1.

In April this year, MART ruled that A1 had violated antimonopoly legislation by discontinuing its archived “Bez Limita” and “Bez Limita 2.0” tariff plans from June 1 and transferring subscribers to the active “Drive Unlim” tariff plan, which carries a higher monthly fee.

The operator challenged the decision in the Supreme Court. The court ultimately ruled in favor of the ministry and dismissed A1’s application to have MART’s decision declared invalid.

The Supreme Court’s ruling is not yet final and may be appealed.

MART noted that fines for violating antimonopoly legislation may amount to up to 10% of a company’s annual revenue from the sale of goods or services in the relevant market, but no less than 500 base units (22,500 Belarusian rubles).
