The Prosecutor’s Office of Minsk’s Tsentralny District identified several cases in which managerial positions at private companies were held by individuals who had previously been dismissed under what Belarusian law defines as “discrediting circumstances.” Their appointments had not been approved by the head of the district administration.
Under Belarusian law, if it is established after a person’s appointment to a managerial position that they were dismissed under discrediting circumstances within the previous five years, the employer must obtain approval for the appointment from the head of the district administration where the organisation is registered.
The inspection found that 15 people had been appointed to managerial positions in violation of the law.
The prosecutor’s office noted that the term “managerial position” applies not only to the head of an organisation and their deputies but also to other employees performing organisational and administrative functions.
The prosecutor’s office issued two compliance orders to the organisations’ management. Four employees were removed from their positions, while two were subjected to disciplinary measures.
Five administrative proceedings have been initiated against responsible company officials for violating employment regulations.
