The Ministry of Antimonopoly Regulation and Trade has published a roundup of cases involving improper advertising.
OJSC Hrodna Meat Processing Plant used the slogan “We’re at the top – and we’re here to stay!” in its advertising. The advertisement was found to be improper. According to the ministry, the phrase creates the impression that the company’s products are superior to those of other manufacturers.
“The company argued that the word used is a registered trademark. However, this does not justify the use of wording that creates the illusion of unquestionable leadership,” the ministry explained.
Another case involved advertising by the self-service laundry company Pink Diamond LLC. The ministry objected to a photograph showing a spacious facility filled with washing machines and dryers.
“In reality, however, the premises were smaller, and there was far less equipment,” the ministry said in describing the violation.
“VIZABAY LLC advertised itself as an official partner of the KENTAVR insurance company, citing its inclusion in the Ministry of Finance’s register of insurance agents. However, the company had already been removed from that register, so describing itself as a partner was unjustified,” the ministry said, describing another case.
Finally, VFS Bay LLC also received a complaint after using the VFS Global name. The visa centre operator did not indicate its own company name or registration number, even though the services were provided by the Belarusian legal entity.
“A trademark licensing agreement does not grant the right to replace a company’s legal name with a brand name,” the ministry explained.
