In Hrodna, a child with disabilities born in 2011 has been removed from his family after prosecutors ordered a second review of his living conditions and care. Following an additional assessment, the court ruled that the boy should be placed in a specialised institution for children with disabilities.
The social investigation was prompted by reports of an unsafe family environment. The child has been assessed as having a Category 4 loss of health. His mother has a Group II disability related to a mental health condition, while his father did not live with the family and refused to take part in raising or caring for his son.
As the Prosecutor General’s Office said, the investigation found that the woman was unable to provide the child with the necessary care, including adequate nutrition, hygiene, a proper daily routine and timely access to medical assistance. It also found that she had difficulty responding to dangerous situations and managing money.
The initial social investigation did not identify the child as being in a socially dangerous situation. However, no assessment was made of whether the mother’s mental condition enabled or prevented her from fulfilling her parental responsibilities.
After the prosecutor’s intervention, the educational institution responsible for the case conducted a second review of the family’s living conditions. In addition, a medical advisory commission concluded that the mother’s health condition prevented her from carrying out her parental duties.
Following the second review, the local education department, acting as the guardianship authority, filed a lawsuit seeking to terminate the father’s parental rights and to remove the child from the mother’s care without depriving her of parental rights.
The Kastrychnitski District Court of Hrodna granted the claim. The ruling has entered into legal force.
The boy is now living in a specialised institution for children with disabilities.
“He is receiving appropriate care and special attention is being paid to his development,” the Prosecutor General’s Office said.
