Prosecutor’s Office Deems Homeowners Association’s Power Cutoff to Debtor Illegal

A homeowners association cut off electricity to a resident who owed it money. The prosecutor’s office deemed the practice illegal. The incident occurred in Minsk District.

The woman owed the homeowners association payment for housing and communal services. The association switched off the subscriber’s main circuit breaker and restricted access to the electrical panel by installing a locking device. The electricity remained disconnected for 11 days, until the woman repaid the debt.

The prosecutor’s office deemed the actions illegal. The statement noted that the woman had an electricity supply agreement with Minskenergo.

“Therefore, Minskenergo is the provider of the service and is authorized to suspend electricity supplies to a consumer in accordance with the procedure established by law.

Since the homeowners association is not an electricity supplier, it had no right to suspend the electricity supply because of arrears in payment for housing and communal services,” the prosecutor’s office said.

As a result, the homeowners association was sent a letter warning against similar violations.
